Social Impact Assessment for hotels and liquor stores (liquor)
New laws apply to hotel and liquor store licences from 1 August 2004. The laws introduce a social impact assessment (SIA) process for the grant and removal of these licences.
These laws, introduced by the National Competition Policy Liquor Amendments (Commonwealth Financial Penalties) Act 2004 and the Liquor Amendment (Social Impact Assessments and Licence Fees) Regulation 2004, do not apply to any other liquor licences (including vignerons) or registered clubs.
This Act amends the Liquor Act 1982 by:
- replacing the ‘needs test’ with a social impact assessment requirement;
- prohibiting a service station being granted an off-licence (retail); and
- extending established restrictions on granting an off-licence (retail) for convenience stores, to also include other general stores such as mixed business shops, corner shops and milk bars.

Supporting the Act is the Liquor Amendment (Social Impact Assessments and Licence Fees) Regulation 2004. The Regulation amends the Liquor Regulation 1996 to detail the requirements for the social impact assessment process.
