Wine sales at trade fairs, wine shows and producers’ markets

There are two options under the liquor laws where take away alcohol sales can be made directly to the public at trade fairs, wine shows and producers' markets or fairs (sometimes referred to as farmers’ markets).

1. Direct sale at wine shows and producers' markets or fairs

A wine producer who holds a producer/wholesaler licence in NSW can sell and supply their product (known as the "licensee's product") directly to the public at a wine show and at a producers' market or fair

Sale or supply must be to customers for tasting at the licensee's display area or stall, or take away sales in sealed containers. Alcohol cannot be supplied to a person who is intoxicated, or to under 18s.

The local police, the local council and the Casino, Liquor and Gaming Control Authority must be notified by the organiser of the show/market/fair at least 7 days before it is held. A notification form is available for organisers to complete. Only one notification is necessary, and it can be provided for a show/market/fair held on multiple dates during a year.

Sales can only be made at a wine show if it is held by a recognised wine or vineyard association or industry association.

Sales can only be made at a producers' market or fair if the primary reason for the market or fair is to allow farmers or primary producers to display and sell their products directly to the public.

The market or fair must include a minimum of 10 farmers or primary producers displaying their produce for sale directly to the public. The 10 farmers or primary producers need not all be wine producers – they can produce other food and beverage products.

The market or fair must be promoted as a market or fair at which farmers or primary producers display and sell their products directly to the public.

*What is licensee's product?

Wine producers can only sell "licensee's product" at a wine show, or producers' market or fair.

"Licensee's product" that is wine must be uniquely the licensee's (or a related corporation of the licensee’s) own product, and it must contain at least the following percentage of wine:

"Licensee's product" that is not wine must be produced on the wine producer's licensed premises (or a vineyard related to the licensed premises) from fruit grown on the licensed premises or vineyard. Examples of these products include cider and beverages made from citrus and stone fruits.

2. Apply for a limited licence at a trade fair

A limited licence at a trade fair can permit the sale of take away alcohol. Sale for consumption at the fair can also be permitted. The applicant does not need to be a wine producer.

Wine producers from other states may wish to consider this option if they wish to sell their wine directly to the public at a trade fair in NSW.

What is a trade fair?

A trade fair is an exhibition at which organisations and businesses in a specific industry can showcase and demonstrate their products and services. A limited licence for a trade fair can be issued for a wine show, and for other types of shows that are trade fairs – such as a food show, an agricultural show, a travel show, or an outdoor equipment show.

The liquor sold at the trade fair need not be limited to wine – it may also be beer and spirits. Conditions and restrictions applying to liquor sales will be determined by the Casino, Liquor and Gaming Control Authority.
