I am selling food hampers and flowers as a gift. Is a liquor licence required when alcohol is included with the gift?

A liquor licence is not required to sell alcohol that is included in the sale of flowers or food designed to be delivered as a genuine gift to a person – such as a gift basket or bouquet of flowers. 

The alcohol included in the gift must be purchased from a liquor retailer. The maximum volume of alcohol in each gift cannot exceed 2 litres.

The gift must be packaged and presented in such a manner that it would be taken to be a gift.

The gift can only be delivered to an adult who is not the purchaser. It cannot be delivered to a person at the location where the gift was purchased.

Gifts must be delivered between the hours of 7am to 7pm.

Fact sheet – When a liquor licence is not required?

Prior to 1 July 2008 as a licensed venue we were required to have our liquor licence on display and accessible to the public. Is that still the case?

No, that is no longer a requirement. The law now states that the licence must be produced if requested to do so by a police officer or inspector while at the licensed venue. Also this document, together with any licence-related authorisation and any conditions imposed by the Authority, must be available at all times to venue staff.

I lost my RSA certificate. Can you send me a copy?

No, we don’t hold copies of RSA certificates. They are held at the training organisation where you did your RSA course.

I am in the process of organising our monthly producers markets. I have been told by some local vignerons that they can now attend the markets and actually sell their own wines. Is this correct?

Vignerons (now known as wine producers) are able to sell their wines at farmers markets, by the glass for tasting purposes only at the licensees stall or in sealed containers to be consumed away from the market. To be able to do this there must be at least 10 stalls at the markets (not necessarily all wine producers) and the organiser of the markets must notify the Casino Liquor and Gaming Control Authority, on the appropriate form, at least seven days before it is held.

I own a bed and breakfast establishment with room for 10 adult guests and wish to sell alcohol to persons staying at the B&B. What is the law in relation to the maximum number of people I am allowed to have staying to be able to serve alcohol?

The law requires that no more than eight adult guests are staying at any one time for you to be able to sell alcohol without requiring a licence. However, before you can commence selling alcohol you must have notified the Authority on the appropriate form.

We applied for function for our football club’s grand final; the game was postponed to due the ground being underwater. What do we need to do to change the date to the following weekend?

You don't need to notify the Authority. The law states that if an approved function is postponed, approval by the Authority extends to the new date. As a matter of courtesy you should notify the local police.
