Changes to shutdown exemptions
Two types of exemptions are available. Both exemptions relate to the six hour shutdown only. If granted an exemption, venues must still shutdown the operation of all gaming machines for three hours every day. The three hour shutdown period operates between the hours of 6.00am and 9.00am unless the Casino, Liquor and Gaming Control Authority has granted special approval for a different three hour shutdown period.
Venues can apply for an exemption to the six hour shutdown on Saturdays, Sundays and public holidays provided they satisfy a number of criteria established in guideline: 3 hour shutdown period developed in consultation with industry and community groups. These guidelines include requirements for tourism, operating hours of neighbouring venues and the history of the premises’ trading hours.
Hotel and club venues can apply for an exemption to the six hour shutdown on each day of the week on hardship grounds. This exemption requires the Authority to be satisfied that a venue will suffer hardship to the extent specified in Ministerial guidelines.
These guidelines have been developed to specify to the Authority what matters must be taken into consideration when making decisions on the hardship exemption. The guidelines include matters relating to gaming machine profits, employment, salary and non salary costs, donations, links with other venues and problem gambling counselling services, harm minimisation programs, renovations, services offered, non-smoking policies and staff training.
